Terms of Service — Blink AI

These Terms of Service (“Terms”) govern your use of the Blink AI mobile application and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum legal age required in your country) to use the Service.

If you are under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.

2. Accounts & Authentication

Certain features require an account. We use Sign in with Apple for authentication.

You are responsible for maintaining access to your device and Apple ID and for all activity conducted under your account.

We are not responsible for unauthorized access resulting from your failure to secure your device or credentials.

3. The Service (AI Image Generation)

Blink AI allows you to:

  • Capture or upload photos

  • Enter text prompts

  • Generate edited or newly created AI images

AI outputs are automatically generated and may be inaccurate, unexpected, or unsuitable.

You are solely responsible for reviewing outputs before use and ensuring your use complies with applicable laws.

We do not guarantee accuracy, uniqueness, or suitability of AI-generated results.

4. Subscriptions, Credits & Billing

A. Purchases via Apple

Paid features are offered through auto-renewing subscriptions and a credit-based usage system.

All payments are processed by Apple via the App Store. We do not collect or store payment card information.

B. Auto-Renewal & Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

You can manage or cancel subscriptions through your Apple ID / App Store account settings.

C. Credits

Your subscription may include periodic credits used for AI generation.

  • Credit usage may vary by feature or mode

  • Credits may reset based on your billing cycle

  • Credits have no cash value

  • Credits are non-transferable and non-refundable except as required by law

We reserve the right to adjust credit costs or allocation in future updates.

D. Refunds

Refunds are handled by Apple in accordance with Apple’s policies.

5. Your Content

A. Ownership & Responsibility

“Your Content” includes uploaded images, captured photos, text prompts, and other materials you submit.

You represent that:

  • You own or have necessary rights to submit Your Content

  • Your Content does not violate laws or third-party rights

You are solely responsible for Your Content.

B. License to Process Content

You grant us and our service providers a limited, worldwide, non-exclusive, royalty-free license to host, transmit, process, reproduce, and generate derivative works from Your Content solely for:

  • Operating the Service

  • Generating AI outputs

  • Maintaining, securing, and improving the platform

  • Preventing fraud and abuse

We do not claim ownership of Your Content.

6. Prohibited Use

You agree not to:

  • Violate laws or regulations

  • Infringe intellectual property or privacy rights

  • Generate illegal, abusive, or exploitative content

  • Reverse engineer or bypass security mechanisms

  • Interfere with or disrupt the Service

  • Attempt to exploit the credit or subscription system

We may suspend or terminate access if you violate these Terms.

7. Third-Party Services

The Service relies on third-party providers including Apple (authentication and billing) and backend/AI processing providers.

Your use of those services may be subject to their own terms. We are not responsible for third-party systems outside our control.

8. Intellectual Property

All rights in the App and Service (excluding Your Content) are owned by us or our licensors.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for lawful personal use only.

9. Privacy

Our Privacy Policy explains how we collect and use information and is incorporated into these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted availability, error-free performance, or accuracy of AI outputs.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the total amount you paid via Apple for the Service in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, Your Content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service and other users.

Termination does not automatically cancel your Apple subscription. You must cancel through Apple.

14. Changes to the Service or Terms

We may update these Terms from time to time.

Continued use of the Service after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict-of-law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Indonesia.

16. Apple App Store Acknowledgment

You acknowledge that:

  • These Terms are between you and us, not Apple

  • Apple is not responsible for the App or its content

  • Apple has no obligation to provide maintenance or support

  • Apple is not responsible for claims relating to the App

  • Apple and its subsidiaries are third-party beneficiaries of these Terms
